Your Roku OPT-OUT Letter

Like many of you I have some Roku devices. Once the streaming services managed to compress/strip Standard Definition television far enough the pathetic 25Mbps download speed Internet services available in rural America made it possible to stream. No matter what the Federal Government says, 25Mbps is not high speed broadband nor should it really be considered broadband. It’s definitely better than what you will get with HughesNet’s constantly “throttled” connections and “fair use” meaning the only time you can actually stream anything is 2am to 6am when the service is so overloaded dial-up would be faster.

New Arbitration

Weren’t you morally offended last night when you powered up your Roku device to be greeted with a dialog about a new arbitration agreement and the only button to make it go away was “Accept?” I know I was. I actually pressed the “*” key and scrolled through that entire #MeToo inspired arbitration-mediation-barred-from-class-action agreement. Images of Harvey Weinstein flashed through my mind.

“So this is where is lawyers found a job” I said to myself.

You can’t help but think that if you read the agreement. Buried in that agreement, down in section 1L, are the OPT-OUT instructions.

Here’s the Letter I Wrote

You will have to fill in your name, address, and email. I’m not a lawyer nor is this legal advice. You have just under 30 days since you clicked accept to get a letter on file with their general counsel. I’m sending mine with return receipt so I can prove they got it.

Here’s a clue Roku! If you don’t want class action suits don’t use Agile.

Agile is just muddling through without a plan until the budget is gone and nothing truly usable has been created, just something you try to tell people is usable.

This letter is to inform you that I officially OPT-OUT of all arbitration, mediation currently splashed onto Roku devices with no method past other than to accept and any future such attempts to trap individuals into non-court non-class-action methods of correcting corporate bad behavior. I fully reserve my rights to join any and all class action suits as I see fit if and when I fit the class of the action. I in no way give up my right to seek justice in a court of law and I firmly believe all such arbitration clauses are just as unethical/illegal as all the ones uncovered during #MeToo with Harvey Weinstein and his ilk.

Summary

It is my personal opinion that upper management, board of directors, and all their lawyers should face a mandatory minimum of 7 years in medium security without hope of early parole for attempting to force such things on the general public. Hopefully this will help you write your own.

Remember: This has to be sent in the Postal Mail. Since they want to be assholes that way, send it return receipt.

Roland Hughes started his IT career in the early 1980s. He quickly became a consultant and president of Logikal Solutions, a software consulting firm specializing in OpenVMS application and C++/Qt touchscreen/embedded Linux development. Early in his career he became involved in what is now called cross platform development. Given the dearth of useful books on the subject he ventured into the world of professional author in 1995 writing the first of the "Zinc It!" book series for John Gordon Burke Publisher, Inc.

A decade later he released a massive (nearly 800 pages) tome "The Minimum You Need to Know to Be an OpenVMS Application Developer" which tried to encapsulate the essential skills gained over what was nearly a 20 year career at that point. From there "The Minimum You Need to Know" book series was born.

Three years later he wrote his first novel "Infinite Exposure" which got much notice from people involved in the banking and financial security worlds. Some of the attacks predicted in that book have since come to pass. While it was not originally intended to be a trilogy, it became the first book of "The Earth That Was" trilogy:
